The Hard Truth: Most Families Are Not Prepared

If a crisis happened tonight… would your family know what to do?

The reality is:

  • Many people do not have a trust
  • Others have outdated or incomplete documents
  • Some believe a Will avoids probate (it does not)

When documents are missing or not properly set up, families are often forced into:

  • Probate court
  • Delays in accessing assets
  • Increased legal costs
  • Emotional stress during an already difficult time

Why This Conversation Matters (Especially in Arizona)

Arizona has specific laws that can either protect your family—or complicate things depending on how your documents are structured.

During the show, we discussed key tools that can make a significant difference:

1. Trusts (and the Importance of Funding Them)

A trust can help avoid probate—but only if it’s properly funded.

👉 This means assets must actually be titled in the name of the trust.
Without funding, even a trust can fail to avoid probate.


2. Beneficiary Deeds (Transfer-on-Death Deeds)

Arizona allows beneficiary deeds, which can transfer real estate without probate.

However:

  • They must be recorded correctly
  • They don’t solve every situation
  • They can create complications if not coordinated with a full estate plan

3. Powers of Attorney (POA)

One of the biggest issues I see?

Families assuming, they have the right POA—only to find out it’s not valid when needed.

Arizona recognizes:

  • Financial Power of Attorney
  • Medical Power of Attorney
  • Mental Health Power of Attorney (often overlooked)

Without the correct POA, families may be forced into:

  • Guardianship
  • Conservatorship
  • Court involvement during a crisis

Real-Life Impact: What Happens Without a Plan?

In my work as a Certified Probate Real Estate Specialist (CPRES) and REALTOR® in the East Valley, I’ve seen:

  • Homes sitting vacant while families wait for court approval
  • Out-of-state personal representatives overwhelmed trying to manage Arizona property

  • Reverse mortgage properties becoming more complex without proper planning

These situations are preventable.
