The Education Department has confirmed to BuzzFeed News that it will not investigate or act on complaints from transgender students who claim that they were prevented from using a bathroom of their choice in public schools.

Shortly after President Trump took office, the department repealed Obama-era orders that all of America’s students be allowed to use whichever bathroom they wished.

A spokesperson said that while certain complaints related to transgender discrimination may be investigated, bathroom complaints will not be.

The issue is now in the hands of the courts after several states challenged it.
