The Justice Department said Friday it will not prosecute former IRS executive Lois Lerner for targeting conservative groups during the 2010 and 2012 elections.

The Daily Caller reports Assistant Attorney General Kevin Boyd said in a letter to top Republicans on the House Ways and Means Committee the DOJ will not pursue charges against Lerner, who oversaw the IRS division that reviewed tax exempt organizations, citing a lack of evidence.

Republicans in the Ways and Means Committee accused Learner, who has since retired from the IRS, of obstructing justice and misleading Congress.

They called the DOJ decision “a miscarriage of justice.”
